Brazil ANATEL - Type Approval: Overview
The Agência Nacional de Telecomunicações (ANATEL) is the official authority responsible for regulating telecommunications equipment and radio frequency (RF) devices in Brazil. It ensures that all telecom and RF products entering the Brazilian market comply with national technical and regulatory requirements. Products that use radio frequency spectrum or connect to public telecom networks must undergo a mandatory ANATEL certification and homologation process before they can be imported, sold, or used in Brazil. Foreign certifications such as CE are not accepted for regulatory approval purposes, and all applicable testing must be conducted within Brazil at accredited local laboratories.
For mobile phones, Brazilian legislation requires separate testing of the mobile phone, charger, and battery. Therefore, if the charger is included in the final commercial package, it significantly impacts the total certification scope and overall cost. Certification is carried out through an authorized Designated Conformity Assessment Body (OCD), followed by submission to ANATEL for issuance of the Homologation Certificate. Once issued, the certificate remains valid for 2 years. Product labeling is mandatory in Brazil. Generally, 5 to 8 units are required for laboratory testing, depending on the product category and applicable test scope. The overall certification process typically takes between 12 to 15 weeks, provided documentation is complete and laboratory testing is successful.
In Brazil, a Local Representative is mandatory. Although both the manufacturer and the local representative are listed on the certificate, the document is legally issued and valid exclusively under the Local Representative (homologation holder), who assumes full legal responsibility before ANATEL. The Local Representative must respond legally before ANATEL, request and renew homologation, maintain documentation and traceability, and assume post-market responsibilities such as complaints handling, inspections, and recalls. Manufacturers may either open a Brazilian company (CNPJ), which involves tax and legal obligations, or appoint a local representative in Brazil, which is the most common and practical solution for foreign companies.
