New Regulatory Decree on Radio Equipment Certification and Installer Approval in Niger

Niger's ARCEP has introduced a new decree to regulate the certification of radio equipment and the approval of installers, aiming to ensure that all equipment and installations are safe and meet international standards. Manufacturers and importers must seek approval from ARCEP before selling equipment, and installers must be officially accredited. This decree replaces the 2015 regulation and is based on Law No. 2018-45 and Ordinance No. 2022-04, which govern electronic communications in Niger.


Certificates are now issued for a period of 3 years instead of the previous 10, containing technical and administrative details, and must be granted within two months of submission. Radio equipment must meet safety, interoperability, spectrum efficiency, network protection, user accessibility, and data privacy standards.


Installer Approval and Oversight:

Installers are required to obtain official accreditation by meeting specific national standards set by ARCEP. This accreditation is valid for two years and can be renewed. To ensure ongoing compliance. Any failure to meet the regulatory requirements may result in penalties such as fines, withdrawal of homologation, or suspension of approvals.


Renewal of Type Approval Certificates:

Type approval certificates can be renewed if the equipment meets required standards, and new certificates remain valid until expiration. Renewal applications, including a fiscal stamp, must be submitted at least three months before expiry.


Transition Period:

Certificates of Type Approval and installer accreditation issued before the implementation of this decree No. 000010/MCP/EN/SG/DL on February 18, 2025, will remain valid until their original expiry date. Manufacturers and installers who have not yet obtained the required certification or approval are granted a transition period of six (06) months from the date of the decree to comply with its provisions.
